Disclosure Statement on the Protection and Processing of Personal Data

This Information Notice has been prepared by Tena Elektrik Mühendislik Danışmanlık Sanayi ve Ticaret Limited Şirketi ("Tena Elektrik" or the "Company"), acting as data controller, pursuant to Article 10 of the Turkish Personal Data Protection Law No. 6698 ("KVKK") and the Communiqué on the Procedures and Principles for Compliance with the Obligation to Inform.

1. Data Controller

Your personal data is processed, within the scope described below, by Tena Elektrik, acting as data controller, located at Bahçelievler Mah. Yeşilpalmiye Cad. No:14/9 Üsküdar / Istanbul.

2. Personal Data Processed

Within the scope of our website and service processes;

• Identity data: first name, last name
• Contact data: phone number, e-mail address, company/organization information
• Customer transaction data: request and quotation contents, project information, submitted files
• CV data: CV contents submitted in human resources applications
• Transaction security data: IP address, cookie records, site usage data

3. Purposes of Processing Personal Data

Your personal data is processed, subject to the conditions set out in Articles 5 and 6 of the KVKK, for the purposes of;

• Conducting site survey, quotation and sales processes,
• Performing installation, commissioning and periodic maintenance services,
• Responding to requests and complaints, and carrying out communication activities,
• Conducting human resources and recruitment processes,
• Fulfilling obligations arising from contracts and legislation,
• Sending newsletters and promotional communications where you have given explicit consent

as listed above.

4. Legal Grounds for Processing

Your personal data is processed pursuant to Article 5/2 of the KVKK on the legal grounds that "processing is directly related to the conclusion or performance of a contract", "processing is mandatory for the data controller to fulfill its legal obligations" and "processing is necessary for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not harmed"; in cases falling outside these grounds, it is processed on the basis of your explicit consent.

5. Transfer of Personal Data

Your personal data may be transferred, to the extent strictly necessary for the performance of the service, to our suppliers and business partners, and, within the scope of fulfilling legal obligations, to authorized public institutions and organizations, in accordance with the conditions set out in Articles 8 and 9 of the KVKK. Your data is not transferred abroad.

6. Method of Collection

Your personal data is collected through the forms on our website, e-mail, telephone, our WhatsApp contact line and face-to-face meetings, by partially automated or non-automated means.

7. Retention Period

Your personal data is retained for the period required by the processing purposes and the statutory limitation periods prescribed in the applicable legislation; at the end of these periods it is deleted, destroyed or anonymized.

8. Your Rights Under Article 11 of the KVKK

Under Article 11 of the KVKK, by applying to the data controller you have the right to;

• Learn whether your personal data is being processed,
• Request information if it has been processed,
• Learn the purpose of processing and whether the data is used in accordance with that purpose,
• Know the third parties to whom your data is transferred domestically,
• Request correction if the data is incomplete or inaccurate,
• Request deletion or destruction of the data within the framework of Article 7 of the KVKK,
• Request that corrections/deletions be notified to the third parties to whom the data has been transferred,
• Object to a result arising against you from analysis carried out exclusively by automated systems,
• Request compensation for damages if you suffer harm due to unlawful processing

as set out in the law.

9. How to Apply

You may submit your requests, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, in writing to Bahçelievler Mah. Yeşilpalmiye Cad. No:14/9 Üsküdar / Istanbul or by e-mail to [email protected]. Your application will be concluded free of charge within 30 (thirty) days at the latest.
